If you’ve ever bought Kirkland tequila from Costco, this is one lawsuit worth knowing about. A proposed class action claims Costco falsely labeled certain Kirkland Signature tequilas as 100% agave. To be clear up front: this is an ongoing lawsuit, not a settlement. There is no claim form and no payment amount has been set.

If you bought it, it’s still a good idea to hang on to any receipts or Costco purchase history in case a settlement ever happens. Costco members can usually see past purchases in their account.

Here’s What Happened

The lawsuit alleges that Costco marketed certain Kirkland tequila products in a way that consumers say was misleading. Costco denies the allegations and has asked the court to dismiss the case. Nothing has been proven. If the case ever settles, a court-approved administrator would announce who qualifies and how to file.

I share cases like this early so you are not caught off guard if a settlement is announced later, not because there is money available today.

Do You Need Your Costco Membership?

One of the biggest questions I get is: “I don’t even have my Costco membership anymore… can I still file?”

There are no claim requirements yet because there is no settlement. If one is approved, the settlement notice will spell out what proof, if any, is needed.

Do You Need Receipts?

Can I File Anything Right Now?

No. There is no settlement claim to file. Some services, including ClaimMoney.com (a referral partner of this site), let you sign up for updates, but signing up is not filing a claim and does not mean you qualify for anything. You can also follow the case through the plaintiffs’ law firm page linked in the verification box above.

Tiffany’s Tip

Lawsuits like this can take years and many never pay out. Save your purchase history now so you’re ready if a real settlement is ever announced, and be wary of anyone promising a specific dollar amount today.
